Upto broadband scam

I recently switched from cable to fibre Internet. I bought the 5-2 package. 5 megs up 2 megs down. I am not getting 5 meg down and 2megs up. I have run the verizon speed test on their site for 2 weeks. I have got anywhere from 2800-4500 up and 225-575 down. I finally got a verizon tech today and we went over everything and still end up with 4500 and 500. So then a supervisor comes on to point out that I signed up for the 'Up to' 5 meg up and 'Up to' 2meg down service. What that means is anything they supply me is up to 5000 and 2000???? This is total bull $hit. He pointed out it says it on their web site and all internet service providers sell their service that way. So what the hell are we buying??? Has anyone else run into this?
