I entered a contract to buy a home in California. The sellers had problems with the title and since it was approaching 3 months my loan had expired. I would have to apply for another loan at 1% point higher. Another $450.00. But the sellers had breeched the contract by not providing me with a Certified Title Search Certificate. I contacted my attorney he read the contract and said I had an open and shut case. My attorney sent the broker a letter requesting return of my funds. No dice. I later recieved a summons to an Interpleader Court appearance. My attorney told me it was similar to small claims court and intimated I probably wouldn't even need an attorney. He said just take my contract all documents and a timeline and plead my case. Long story short, the broker hired an attorney, the seller hired an attorney. The judge wasn't interested in what I had to say7 because I wasn't represented by an attorney. The broker left with $4.000.00 and the sellers lsft with$4.000.00 and I left with sore nuts. Moral...ALWAYS go tom court with an attorney.
