FrankOB May 4, 2006 To Whom It May Concern: On March 4, 2006, we purchased a vehicle from Matt Blatt Imports. At the time of sale we had $1500.00 to put down on this vehicle. However due to the fact that AIG insurance company had totaled our other vehicle, we were expecting a settlement check. Although the exact amount was not given to us, it was estimated in the $3000.00 to $3500.00 range. Since we wanted to put down more money, the salesperson suggested we write up two contracts, one to include the anticipated additional $3000.00 from AIG plus actual cash at time of signing of $1500.00 totaling $4500.00. We were also asked to write two checks, one for $1500.00(check No.1385) deposited March 6, 2006 and a second for $3000.00(check No. 1386) deposited March 20, 2006. The deal was to go with the second contract for $1500.00 down if we did not receive the insurance check within the 7 to 10 days from date of purchase was allotted to us by Matt Blatt Imports, which would allow us till March 14, 2006 to receive, deposit and clear the anticipated funds from AIG. We did not receive the insurance check until March 20, 2006(AIG check No. 068441403) well past the allotted time. We also verbally spoke with the salesperson and finance manager on numerous occasions, asking for not only our check back but a copy of the second contract for $1500.00 down and payment information. Moreover, after noticing that documentation was missing from our paper work on march 4, 2006, we called the dealer and ask for a copy of second contract to be forwarded to us, along with a window sticker displaying options and price since it never was on the car at the time of purchase and also was not present in the paperwork after the sale was “ finalized” .We verbally asked for all the above information on march 4, 2006, same day as sale and numerous times afterwards, including the return of our check. Since we did not receive it, and well beyond the 7 to 10 allotted to us had came and went we finally stopped payment on it. Needless to say, we never received the second contract and they are denying it even exists now. I had spoken to three different people regarding all the issues above and not one of them ever denied the existence of the second contract to either of us. So ask them for the contract numbered Deal: 586 and you should see the truth. If not, well it does not matter since we were fraudulently and purposely misled on so many accounts by numerous people that day and the days to follow that I am simply disgusted. Fact remains, we were not presented with everything we signed the day of purchase. Yet by reading this letter and looking at our documents and there dates we believe the truth is obvious. Why would we write two checks with such different amount and cashed so far apart if this were not the truth? Just because Matt Blatt Imports fraudulent acts and practices caught up to them is not our Burdon. Never were they given permission to cash that check some seventeen days from the date of sale just the concept is ridiculous. All our documentation supports the truth. Fact: 1) Did not receive insurance check until after the allotted time: see attached documents for verification 2) Never verbally or written gave permission to deposit check 3) Was intentionally and maliciously missed lead by salesman and finance manager into signing two contracts? 4) We were coerced into give them a $3000.00 check to hold “just in case”. 5) Contract No. 585 was for $4500.00. 6) Missing contract No. 586 was for $1500.00 7) Contract No. 586 superseded since we signed it following contract No. 585; therefore No. 586 is the legal document. 8) Failure to provide any and all documentation signed at time of purchase is Fraud. 9) Failure to have vehicle price tag clearly displayed at time of sale and presented to us is Fraud. 10) Purposely mislead and the signing of two contracts for the same purchase is fraud 11) Suppression and/or omission of any signed documentation at time of purchase is Fraud. If you disagree, just consult the consumer fraud hotline for verification. Conclusively, because of the malicious way things were handled by Matt Blatt, the suppression of documentation, and the down right lying, along with the fact that they sold us a lemon, we have hired an attorney.
