
Farmers Bad Faith

Incident In December 2004, I was injured in an auotmobile accident when my 'parked' car was suddenly ran into by another party, who was obviously speeding and not paying attention to where he was driving. Farmers insurance declared that my car was 'a total loss'. They told me that it was worth only about $1147 and that I had no options in regards to settling or having my car repaired. They literally forced me to accept, what they determined my car to be worth. As a result of the collision, I sustained serious 'whiplash' injuries including 'incomplete spinal cord damage'. After attempting to negotiate a settlement failed, due to Farmers 'no negotiation' stance a lawsuit has been filed, in Salt Lake City where the accident occured. Farmers has blatenly used deceit and unfair trade practices in an attempt to coerce me into dismissing my claim for my injuries. Additionaly Farmers representatives have stated that 'because I was driving an older car', which they valued at$1147., the amount of my personal injuries could not possibly be worth more than 'about $700.00!' Farmers have refused to negotiate, 'unless I dismiss my complaint, First', and then 'maybe they would consider 'some type of settlement offer. Farmers has since canceled the insurance policy of the other party and the other party 'wants nothing more to do with Farmers'. Damage Resulting In August 2005, a demand letter was sent to the insurer seeking $58,960 for damages, including PIP payments and reimbursement to the no-fault carrier, as well as lost wages and for pain and suffering. I have suffered a considerable amount of physical, mental, emotional, and spiritual stress and anziety, much of which I belief has been intentional and malicious for the purpose of wearing me down and dismissing my claim. I would greatly appreciate the opportunity to present my case to an 'experienced' bad faith insurance attorney, who is admitted to the Utah bar.This case is presently pending a summary judgement hearing and as I am not an attorney, I would prefer to arrange for substitution of attorney who will rigorously persue my claims for not only my personal injury from the collision, but also against Farmers representatves for the bad faith handling of my claim.
