Three weeks ago a women pulled out in front of me causing an accident that totaled my truck. She was ticketed at site to failure to yield right of way. She has Allstate Insurance. They admitted liability and put me in a rental from Enterprize for eleven days until we reached an agreement.We reach a verbal agreement on 6-2-06 for a settlement. I was told that a check would be sent out by Allstate asap. On 6-5-06 I received a letter from Allstate to turn my rental back to Enterprise by 6-6-06 to advoid out of pocket expenses. I turned the rental in on 6-6-06 thinking that the settlement check was not far behind. I didn't get my settlement check from Allstate until 6-9-06. Allstate has their banking accounts through Bank of America. So, on the morning of 6-10-06 I went down to the local Bank of America located at 1481 Carl D. Silver Parkway, Fredericksburg, VA. I got there at about 9:45 am in the morning. I stould in line for about 10-15 minutes before it was my turn. I went to the cashier that was advailible. He asks'How may I help you?' I say ' I have an Allstate Insurance claimes check I want to cash. I'll take csh or settle for a cashier's check.' He says ' Well we can't give you cash but we'll make you out a cashiers check at a cost to you of $15.00.' I said ' Fine give it to me.' He says ' I need two proofs of I.D. like a drivers lincense and a credit card.' I said ' Here you go.' and handed them to him He looked confused and then he went to talk to his cashier supervisor . He came back and told me that Bank of America would not cash that check even know that is drarwn for their bank. He say's that ' Allstate has a policy that all their checks are to be treated as deposit only and not to be cashed.' I said 'Okay I,m going to step outside and call Allstate I'll be back in a minute.' So, I walk outside and call Allstste Claims devivsion and ask them if they have such a policly. They said.'No, we don't have such a policy. If you have proper I.D (which I did) then Bank of America schould cash that check.' So I go back inside and theres this guy who comes right towards me. He says 'Can I help you?' I said 'Yes, I need to talkto someone in charge.' He Says'That'll be me . What do yuo need?' I said ' I need for you to cash this check.' He says ' I can't cash that check, that check is for deposit only according to Allstates policy.' I said ' I just got off the phone with Allstste and they said no such policy so you need to cash this check.' He says ' You just talked to a regular customer service rep, they don't know whats going that order comes from hihert checks for deposit onlydoes not want us to cash that check!
