tree trimmer

A big misunderstanding that the guy cut down a 2nd tree, 25 yr. old oak actually in the neighbors yard. It looks like it would be my yard but isnt. I was at work when it happened. I dont want to pay the trimmer for cutting it and the neighbor wants a replacement. Ok if I insist on a little sapling?
