
Rogue Letting Agent

On 4th August 2004 I took tenancy of a property in Bristol and paid the letting agent Neil Seymour rent, deposit and agents fee. The letting company was called Barons Residential Lettings. His letterhead stated that it was operated under licence by Neil Seymour, trading as Barons Residential Lettings. I vacated the property in good order (witnessed by the Landlord Ernie Perrott) on 20th August 2006 and as Neil Seymour wouldn't return my calls I visited him to collect my deposit of £650. Neil Seymour had by this time started trading as Brooklands Lettings and Sales at 196 North Street, Bedminster, England. Neil Seymour eventually wrote me a cheque for the amount in the name of Morgan Thomas. I banked the cheque and it was returned by the bank. On contacting Neil Seymour he told me that he couldn't pay me and didn't owe me – and there was nothing I could do about it. I put the matter in the hands of a collection agency. They have since informed me: • He has two CCJs against him totally over £5000.00 and refused to pay. • Morgan Thomas (the name on the returned cheque) was an individual not a company so the cheque was fraudulent. • Brooklands and Barons were trading names not limited companies (so he is personally liable!). I have discovered today that the tenants in 20A Mount Pleasant Terrace, have also not received their deposit back from Neil Seymour. I don't believe a letting agency should be able to act in this way - take deposits and simply refuse to return them. There is no dispute that it is owed. The properties were left in good order and the cheque with his signature acknowledges his debt to me. I will attempt to recover my money through the courts but my concern is that he is still trading and taking deposits from people every day and they too may not get them back - seemingly entirely at his whim. In the space of a week of investigating, I now know of 4 people he owes and will not pay! This rogue needs to be stopped!
