On May 16, 2006, Linda Booker of Realty Executives came to home to have a contract signed to list my home. After reviewing information, we agreed to list my home at a reduced price. Linda proceeded to tell me her marketing strategy this included advertising continuously in magazines, newspapers, and the Internet. On May 16, I asked how long it would take to sell; her reply was “I will have it sold by the end of the summer.” I inquired on her idea of the end of summer, and her reply was “August.” I signed a contract for Linda to list my home; I was under the impression it was to be a 3-month contract that was to expire in the middle of August. On May 16, 2006 I had undergone a Lasik eye surgery procedure, my vision was extremely blurred and I was unable to read or see clearly. I signed this under the pretence that it was only three months however I was unable to properly read it. Immediately Linda proved herself to be completely negligent and incompetent in many areas. It was listed incorrectly on the MLS, Realtor.com, and Lindabooker.com. The pictures were unacceptable, it was listed as a 4 bedroom + den, it is only a 4 bedroom home, it described a wood fence instead of a block fence, the square footage was incorrect, it offered golf cart parking that doesn't exist, the MLS included my washer and dryer, I specifically stated they were not to be included. I called Linda several times after I reviewed the home on realtor.com to have corrections made. Days would go by and I would not receive a return phone call, this would continue to be an ongoing problem with her. When I finally did speak with her the 1st part of June she guaranteed corrections would be made, and new pictures would be taken. By mid June some corrections were made, but not all, and new pictures were taken, however they would never make it on the internet. At this time she was unaware that I had received no calls or tours of the home, she never took the time to call and ask, or return my messages. After leaving several more messages because only a few corrections had been made she requested to meet with her at her office. At the end of June my mother and I met with Linda regarding the incorrect information still listed on the Internet, and the fact that I had received no calls to view the home. She stated that no realtor would show my home due to new road plans on Jomax. She then stated I had to offer the buying agent an additional ˝ point so would realtors would be willing to show my home. Why would she tell me the home would be sold by the end of the summer then? This contract was signed under false pretences. She later (same office visit) stated it would still be sold by September. None of this makes sense. I also decided to lower the price and add a $5000.00 credit towards closing costs. I questioned where the new pictures were, her response was she assumed everything was corrected but didn't verify it. I did find it odd that Linda stated she had no idea what realtor.com was and asked me how to access it. She stated she had never heard of it but once again I was guaranteed everything would be corrected immediately. An additional two weeks passed and there were very few changes to my home again, and several phone calls went unreturned. The price was changed however it was an incorrect price. My daughter and I were viewing the home on realtor.com several times per day each. By the end of July I continued to get nowhere, days and weeks would go by and my phone calls would go unreturned, the information was still incorrect and I was yet to see the new pictures of my home. On July 27 I left Linda a message stating I thought it was time that I look for a new realtor, one who would return my phone calls and list my home correctly. She did return my call that day and once again guaranteed that everything would be corrected. She said she would have an additional photographer take pictures and corrections would be made. I explained that she was subjecting me to a very stressful state. Once again she stated she assumed everything was corrected but never verified it, and she had no excuse as to why she didn't return my phone calls. We also discussed lowering the price once again. I agreed but said it would be reduced but I would no longer offer a $5,000.00 credit towards closing costs, it needed to be removed immediately. At that time I also wanted to remove the additional ˝ point for the realtors commission. She stated it must stay on due to the new road on Jomax so realtors would be willing to show it. She never mentioned I would be responsible to repay advertising expenses if I did go through with ending the contract. On July 31, pictures were taken for the third time. On this day I called and left her a message informing her she must call realtor.com to have the pictures changed. This phone call went unreturned also. At this time the closing cost credit had not been removed, but the price had been changed. Days would go by and the Internet would not change, still no new pictures, closing costs had not been removed, the MLS included my washer and dryer, her website had the incorrect square footage. On August 2, I requested a copy of my contract; I was under the impression it was over in less than two weeks. I received my contract on Aug. 4, and was shocked when I realized it was actually 7 ˝ months, I would have never agreed to this had it been properly clarified. On August 7, I left Linda a message stating I wanted to be released from my contract I couldn't continue this until the end of the year. My listing was still incorrect and it still took her several days/weeks to return my phone calls. On Aug. 7, she did return my call stating she would only release me from my contract if I reimbursed her for advertising expenses, knowing that I am in an extremely rough financial situation. She stated it would be $350.00. I told her I would let her know. Two hours later I left a message for her to call me and have the appropriate documents available for me to sign. She did call me back within minutes however it was to insult my family and me. She said, “I thought you were a nice person but I was wrong.” She also complained about my mother, daughter, and son asking her general questions, and stated they can go to realty school. I then simply asked to have everything prepared so I may end this. She said this would be taken care of tomorrow and that she would call me. I was completely amazed that a so-called professional could be so unprofessional and unethical. On Aug. 8, no surprise to me my calls went unreturned. I sent an email requesting the information to end the contract; she replied she would call me tomorrow. (Emails are enclosed) She also stated in the emails that the emails were from my daughter (Carlye Giannangelo), after I stated several times they were from me. I do not have my own email account, I do use my daughters, and this was not new to her. She continued to be completely unprofessional even in emails. On Aug. 9, my calls (2) went unreturned again. I again sent an email, it was then her assistant called with an amount of $752.00. I immediately went to her office with a cashiers check for $752.00 and signed to be released from my contract. I was charged $87.00 for sign (a sign that is reused and was returned), $140.00 for 2 ads in the AZ Republic (Linda promise to send me copies of all ads I never received this), Flyers $75.00 (I had requested the square footage to be listed, these were never done to my satisfaction), 3 ads, Homes Ill., Homes and Land, and Northwest Valley news (I didn't receive a copy of this), and 3 internet (photos) $320.00. This proved to be more lies, she told me $350.00, and it more than doubled. I did not dispute it at the time because I felt it was just important to get rid of her. I couldn't continue to deal with someone so incompetent and unprofessional. I paid for her negligence and incompetence. I never saw the pictures that I have now paid for. Linda Booker did not keep her end of the contract why should I be expected to keep mine and pay for her negligence. I did not charge her for all of the money I have lost due to her incompetence, the price of my home continued to drop while others in the neighborhood sold for more money and less square footage. It does not state in my contract that she is allowed to be negligent and incompetent and I am expected to pay for it and deal with it. I am enclosing a print out of the realtor.com add printed on Aug. 9 that shows it was still incorrect. My contract does not state that I would be responsible for advertising expenses if I chose to terminate it. However, it does state, “6. COMPENSATION TO BROKER. Owner agrees to compensate Broker as follows. A. RETAINER. Broker acknowledges receipt of a non-refundable retainer fee of __________ payable to Broker for initial consultation, research, and other services. (Linda filled the empty space in with a 0) I am requesting that that appropriate action be taken. I am also requesting my $752.00 to be returned. Contracts are between two people and both people should have to abide by it. She did not fulfill her end of the contract; I should not be expected to fulfill mine.
