We listed our home with John Hausam ERA in Tulsa, Oklahoma, after receiving 2 letters stating 'We'll sell your house in 180 days or we'll buy it.' We filled out the paper work required for this program in late February, (listed Jan. 9, 06). Our agent quit the business moved out of state so we got another agent (husband/wife). We put $10,000.00 down as earnest money on another house between the time we signed the buy out program papers & our first meeting with the new agents. At that time, we were told our home did not qualify for their buy out program because it was in a rural area. We scheduled a meeting with the office manager & he said this was the first he heard anything about this (what's he managing if not the activities of his agents?). He also suggested we could sue the agent. Wrong, the broker is responsible for the actions of his or her agents. Got another agent, what a waste of time. She scheduled an open house but for the wrong date so she ultimately never had it & never returned my calls until the 3 days later. She never personally showed the house. We were told that the first agent didn't have a clear understanding of how the buy out program worked. Who's fault is that? So now we're out $10,000.00, filed a complaint with the OREC, the office manager is lieing about everything, we're still going forward with our complaint. Don't get caught in this trap. We're still in our original home about $10,000.00 less. Less is not more in this circumstance.
