NYPD sucks big time

I have been living in the same buliding for about 3 yrs. My upstairs neighbor is the worst. i have a 2 yrs old son who needs to go to bed at about 8-9pm. this guy starts running around at around 10:30pm every night. he bangs, moves furniture, vacuums, walks around until like 3am. i have called the cops like 10 times. i don't think they bother to even come and ask the dude to keep it down. it's like you call them they tell you to call 311, they tell you to call the cops. nobody does a damn thing. and my 2yrs old suffers. so what am i supposed to do? i either move or i knock the guy off? why should i move? he is the one who is an asshole!!!!!!!
