My Friend's Wife's Secret

I work at a doctor’s office and have access to patient files. Three months ago, my best friend’s wife walked in with another man. Of course, I saw the patients’ file in which they were put down as a couple and they came to treat clap. I was in a quandary and hogtied by patient-doctor confidentiality and the fact that the woman saw me. I kept the secret but I was expecting my friend to come down with the thing and sure as clockwork, he did. Now, I’m not sure if I should tell the poor guy but it will break his heart.

The doctor, not you, had an obligation to report this to the Public Health agency in your community. That agency would then be charged with notifying anyone who was likely exposed to the disease. If you were to take this upon yourself to tell the husband, you would be in violation of the HIPAA laws, and you probably would be caught. The fines and penalties for this are quite severe. Besides it's a moot point now. Since he contracted the disease, he probably knows that his wife has been fooling around with other men.

Unless you want a really expensive law suit on your hands, you keep your mouth shut and when he confronts you on it you say 'you know the law, I can't comment, I am sorry you are going through a hard time but I have to stay out of it.' He will find out. He is either sleeping around also, or will know where he got it.

I think you owe it to your friend to tell him before he gets something worse. Confidentiality be damned! He's getting cheated two ways to Sunday and I don't see how he won't be heartbroken anyway
