i have been on O2 net work for a couple of years and went to carphone warehouse for my upgrade mobile phone. chose my new phone left the shop and started home then noticed that the box said T - MOBILE, i went straight back to the shop within the hour and told them i did not want to go to T MOBILE but wanted to stay on the O2 network so wished to cancel this contract i was told i could not cancel and had to keep this phone i rang my solicitor immediately and he said to take the contract to him and he would check it but as far as he was concerned i had 28 days to cancel. i did this but then went on holiday for a week and when i came home i had a bill for £53.00 i rang and told them i did not use the phone and that it had been disconnected and told them i wanted it cancelled they said to put it in writing which i did immediately. i then received a bill for £450.00 and they had passed the debt to a debt collecting agency who are really badgering me for this money. in my contract it states that if i wish to cancel i would have to pay a nominal fee for cancellation i do not think £450.00 is a nominal fee my solicitor has written to T - mobile and the debt collecting agency but the debt collectors are constantly ringing me at home and demanding the money which i do not have as i am on incapacity benefit and disability carers allowance. i do not mind paying a months rental and returning the phone and i have told them this but to no avail i dont know what to do next.
