misrepresented items by a builder

we bought a new house 1 1/2 years ago it was supposed to have a 4 tone air conditiner we have just found out that the unit in the attic is a 4 ton but the outside unit is only a 3 ton unit. the builder tells us there is nothing we can do becaues we have had the house fof 11/2 years which is over his warrentee.
