mini one handbrake failure

17/06/06 parked my car as usual for work put handbrake on, parking on slight hill. Left work at 5pm couldnt see my car it was 15 yards down hill smashed into lamp post, checked car and the handbrake was still on. so took to mini garage obiously gutted about car, but bmw cant find problem and want me to cash up £1700.
