
Flooded Apartment

Hello, my name is Leah Sitek, I have a fiancé Bryan and a son who is two named Blake. Please take 5 minutes to read through this e-mail and think about your own family. On the 3rd of September the apartment my family and I were living in started to look like a pond. There was water coming up through the floor in our hallway. We called the office to let them know and when the maintenance guy showed up he said it was ground water. They had carpet cleaners come out, tear up the carpet, dry it with fans, and put it back. The next morning, my fiancé, son, and I woke up around 6:00am. Bryan went to the hallway bathroom and almost slipped and fell because overnight the water had come back and this time was much worse. The kitchen, front door entrance, bathroom, and hallway were all filled with water, like a creek. When we called the office, they were unavailable because it was a holiday, our only choice was to leave a message on the emergency line. I had to go to work so I left around 7:00am. After several calls and three hours later the maintenance guy that was on call came over. Here's where the problems start. They brought out plumber's and they knocked holes in the kitchen wall and the hallway, after ripping up the carpet that was soaked. They layed the hallway strip in the sun to dry. In the meantime Bryan had moved all the furniture to the side of the living room that was not wet. After telling us everyday that they will have us back in the apartment tomorrow, we gave up hope and decided to move out. We went to the apartment everyday to video tape and take pictures. They ended up jack hammering the foundation in the kitchen and after filling our kitchen with about 4 feet of mud they found the broken pipe, not groundwater! Long story short, they did not put us in a hotel room, they did not give us money for meals, when we had just paid our rent on time 3 days prior to all this happening. If it weren't for my parents we would have had no where to go and nothing to eat. They lied to us every step of the way, the property manager, Paul has been completely dishonest and did not even attempt to contact us at any time, he sent his maintenance guy, Dave to relay his messages, which he later on told Bryan that I pushed him. COMPLETELY UNTRUE!! The water started coming up on the 3rd and they finished 'fixing' these problems on the 15th. We now have no other choice but to settle with them, so we can pay our bills. We gave them our notice to vacant and did everything right. I did my research and found out what my rights were per the AZ Landlord and Tenant Act which I had to quote to them on several occasions. Now, they are giving us back our rent for the month minus the 1st and 2nd, our security deposits and food at the cost of $30 a day for three people!!! I feel completely violated and I don't feel I should be stuck paying for the water that flooded the apartment. If we weren't there to use these amenities, then why should we pay for them. But the manager says we are lucky to be getting what we are. Even though they won't even pay the water bill or cox, or electricity. We have been treated like we are unimportant and they give us the impression that we are the one's putting them out! When they did not even offer us a place to stay at their expense. I have all the footage of the water, mud and mess. This is NOT about money anymore. I would like people to know how they treat people and maybe save a family from going through this. This is about treating people like you would want your daughter or son or grandson to be treated if they were put out of their home.
