I was seeing a psychiatrist for medication evaluation and medication management. He told me that he was a non-network psychiatrist and that he does not take any insurance. This was not true. According to my insurance company, United Behavioral Health, he was still a network provider when he saw me and therefore misrepresented himself to me. I paid him out of pocket for his non-network rates. I also submitted claims to my insurance company for reimbursement for visits with a non-network psychiatrist. The insurance check was sent to him from United Behavioral Health at the network rate as he, according to United Behavioral Health never removed himself from the network. So far he has kept both the checks I made out to him and the insurance checks that were sent to him out of my insurance health reimbursement account. He has refused to reimburse me even though I was told by clinical network services at UBH that he was contractually obligated to see me at the network rate and not charge me up front. I also suspect, but have no proof that the reason why he called me to cancel my appointment for the day after Easter Sunday (April 17th 2006) to cancel my appointment was because he did not want to accept my insurance. He called me on Easter Sunday to cancel my Easter Monday appt without even giving me one business day's notice. His name is B. Kenneth Nelson, MD in Spring House, PA and I think he treated me in an unethical manner. You don't just dump your patients for a mistake you made in not removing yourself from their insurance network appropriately. This is the content of my complaint. If you seek services from him, I urge you first to make sure he has removed himself from your insurance company network. What I want is my out-of-pocket $230 back that he has refused to pay me.
