Double Billed by Dish Network/Echostar

Mid Sept on 9/16/2006 I paid my monthly bill, this month due to being out of town I ran about two days behind. When I logged online to make my usual payment from my checking account which had subsequently increased over the past few months to $118.16 that was the amount I paid which showed past due, due to the fact that I had been unable to make that payment two days before. The next day I got an email acknowledgement but instead of the $118.16 Dish billed me 2X that amount instead a total of $236.32, nearly causing an overdraft to my account, which I later cautioned them about. An error on their part I initially felt, since it was not what I had submitted for pay and the remaining amount have of that balance was not due for almost another month. I immediately attempted to call and could not get through due to high call volumes and no one returned my calls when left messages so I emailed, both from the Dish website and also as a reply to their acknowledgement via email. In another day or two they responded stating that they are processing an immediate refund allow for 7-10 days. After that time lapsed and my checking account reflected no refund I emailed again, I was then told that a refund was processed on 09/17 and that it was not yet 7-10 BUSINESS days. On the 30 of September clearly well more than 7-10 business days or otherwise still nothing, then I got very annoyed and emailed a very concerned letter strongly urging their immediate attention and threatened to report Dish/Echostar and take serious action. I stated that any overdraft or insufficient funds charges I would hold them accountable, and when I got no email responses I called late night early morning, only to not be told that a check was just issued on 10/03/2006, so instead they lied about ever processing a refund that I was sitting and waiting for to reach my account in order to pay other bills, bills that I have been charged late for since I could not submit payments due to the fact they had hostage these additional funds. They never returned the excess money that was drafted from my checking account by their error as they said, and now they were claiming that there was nothing further they could do, even though I had told them all along that money had been allocated to pay other bills and this incident could potentially overdraw my checking account.
