Doctor is a crook

I had foot surgery in May for Plantar Faciitis at which time the doctor was paid $4400 from my insurance company. My foot is not any better, yet he demanded I pay him the balance out of pocket that the insurance didn't pay. Like a dope....I paid him an additional $2700! I regret that now. It is July and my foot is still not better. I want my money back. The reason, I found out last week from the insurance company, that I had to pay so much out of pocket is because that doctor was not in network. They told me they were! Does anyone know how I can get my money back?
