Commission for Racial Equality - Do you have to be

A recent complaint to the Commission for Racial Equality in respect of a Racial abuse incident by National Express Drivers met with the response that it was out of time to take action. I have since tried to contact them asking why they consider a possible criminal offence to be out of time. They simply will not reply. Is it because I am White ENGLISH?
