I am writing to you because I want to share my experience dealing with a lawsuit against me that was filed by Cavalier Corporation. Hopefully it will help you. Gregg Martin Horowitz is the attorney who is filing these lawsuits. In 1993, he, his wife Pamela, and her parents, Maxine and Michael Koerner formed a company called Cavalier Corporation. Maxine is President of the company, Michael is Vice President, Pamela is Secretary/Treasurer and Gregg Horowitz is the Director. I found this information on www.sunbiz.org by looking up the corporate name of Cavalier Corporation. I have enclosed a copy for you. This cozy little family began purchasing portfolios from a company called Unifund LLC. Unifund buys portfolios of bad debt from credit card companies such as Citibank, Chase, Household, etc. They buy these portfolios for pennies on the dollar. Unifund, in turn, sorts through the portfolios, then sells them to other entities, such as Cavalier, for a few more pennies on the dollar. The large credit card companies typically give up hope when they cannot collect from you on your debt. They are allowed by law to charge these accounts off and place them in their Profit and Loss Accounts. After seven years, they cannot collect from you. In order to regain some monies from their Losses, they review their files, and give very basic information to companies such as Unifund. The credit card companies DO NOT release any documentation that has YOUR SIGNATURE, such as an application for credit, nor do they release ANY COPIES OF STATEMENTS that may have been sent to you which would reflect your purchases, payments, balances, nor do they release ANY CORRESPONDENCE you may have sent to their firm regarding a dispute of collections. Unifund receives your address, your social security number, and the amount of the Charge Off or amount written to Profit and Loss. That is IT!! When Horowitz and company purchased a portfolio that included my account information he filed a lawsuit against me. I hired an attorney - one that I felt would duly represent me. The court ordered Mediation. My attorney accompanied me to mediation and of course Horowitz showed up. He was arrogant, rude, demeaning and harassing. My attorney even told him that she would not tolerate his rude, harassing behavior. The Mediation lasted approximately 45 minutes and during that time Horowitz attempted to embarrass me and my attorney. Prior to this mediation, Horowitz filed a Request for Admissions which basically asked for any and all documentation that I had from my credit card company. In turn, at mediation, my attorney hand delivered Horowitz a Request for Admissions demanding proof of ownership and bill of sale from Unifund to Cavalier. During mediation I asked Horowitz who Cavalier was and he would not answer. I asked him why the information wasn't placed on my credit file. He stated that Cavalier didn't put anything on anyone's credit report. My disclosures were due on the same day Cavalier's disclosures were due. My attorney told me to fill them out to the best of my ability. I drug out all of my files and correspondence and began putting my documentation together for my attorney to argue the case. I completed the information VERY HONESTLY, but disputed the amount that Horowitz said was due. My attorney sent my disclosures over on the date due. Horowitz WAITED until he received my disclosures and 6 days later submitted his, using MY INFORMATION to file his disclosures. He then filed all of his motions in court, and asked my attorney to give me a settlement order. I signed the order, said to myself “cold day in hell I will ever pay him”, and went about my business. Five months later, Horowitz filed a motion for non-payment and has ordered me to appear in his offices before an accounting firm and to bring all of my financial documents including bank accounts, personal property, stocks and REAL ESTATE. I was extremely angry. I proceeded to begin research on Cavalier and Horowitz and this is what I have found. Cavalier Corporation has filed the following lawsuits in these counties in the past two years: Sarasota County – 501 cases Manatee County – 191 cases Lee County – 495 cases Collier County – 58 cases Pinellas County – 125 cases Hernando County – 2 cases They consist of small claims cases from $500 - $2500, small claims cases from $2500 – 5000, and civil cases from $5000 and up. I then realized why Cavalier doesn't place any documentation with the credit bureaus. I found a few cases where when payment wasn't made to Cavalier, Horowitz filed orders with the courts for the county sheriff to abscond the defendant's vehicle and sell it in a sheriff's sale. I found more cases where Horowitz filed orders with the courts for foreclosure on the defendants' homes. The judges approved the order, Horowitz began foreclosure proceedings and forced people out of their homes – and in all of these cases, the amount Cavalier claimed was due to them was under $15,000. I find it very scary that someone can foreclose on your home and take your vehicle because you defaulted on a credit card account. I also found a few cases where the attorney of record for the plantiff has called Horowitz on the carpet and the cases are still pending. Beware, if you are served with a Complaint from Horowitz/Cavalier - call a GOOD ATTORNEY!!

You are cheats, scumbags and liars. You take homes from families and their children over $2,000 debts that you pay pennies for then do not notify the people that anything is owed. You wait years and then tell people they owe ten grand and are going to take their homes and vehicles. People like you are going to be reported and stopped for what you have done and are doing to good hardworking people that are just trying to survive this hard world. While you live in your huge home and drive your fancy cars people are struggling to pay their bills and feed their children. You have what you do because your a cheat and dishonest not to mention arrogant and rude.
