blown engine on husqvarna mover

Have husq with 21hp vangard engine blown 138 hours. Briggs stratton says I didn't change air filter. thats their second story. first story is I ran It out of oil. I am a retired 22yr mech for AF. I know importance of oil and air filter. They just schrugged me off
